A bodaboda operator was on Thursday arraigned before a Thika court charged with dumping litter dangerously in prohibited place contrary to the Kiambu County Environmental Act.

James Kinyua appeared before the Thika Acting Chief Magistrate, Stephen Mbungi, charged that on January 21, 2015 in Runda estate in the outskirts of Thika town.

He was caught dropping off garbage in a sack thus littering the area.

This was contrary to the Kiambu County Environment Act that prohibits careless dumping and sets a fine of Sh150,000 to any culprit.

The accused denied the charge and accused the County Environment Officers of being out to set him up after he failed to stop after being ordered to.

Giving evidence County Environment Office, Monica Kingori, told the court that the accused was among a group of bodaboda operators hired by apartment owners to clandestinely collect garbage from their premises and dispose it off anywhere.

The Environment Officers have been following them for a long time as they dump the garbage in the middle of the night.

She told the court that the accused person had managed to speed off but was apprehended by members of the public who had seen him.

The accused was freed on a cash bail of Sh50,000 and is set to appear before the same court on April 22, 2015. His Motor bike will however remain under police custody until the case is over.
