A middle aged man was on Friday arraigned before Kisii Law Court for defying traffic rules after he was found operating a motorbike without wearing helmet.

Charles Nyangeri Onyambu, a Bodaboda operator found himself in trouble after traffic officers found him not complying with the New Traffic Amendment Law, which are aimed to bring sanity on roads.

The accused was told that the offence he committed is contrary to set traffic rules as stipulated in section 103 [B] 1 of the New Traffic Amendments Act No. 37/12 cap 403 of Kenya Law.

During his judgement, Senior Residence Magistrate J. M. Njoroge ruled that the accused to serve a jail term of one month or be released on a cash bail of Sh8,000.

Bodaboda operators are required by new traffic laws to put on reflector jackets, helmets and not to carry more than one passenger, failure to which they will be prosecuted before Courts of law.

Initially, Kisii OCPD Tom Mutisya issued a sound warning to Bodaboda operators who will be caught contravening the set traffic laws, saying that it will cost them and they would not like it.

“We understand that it is a business and this is an important activity just like any other, I know many are bread winners in their families, but my humble request to them is for them to maintain traffic rules, we should not cross each others path,” said OCPD Mutisya.
