The High Court has summoned Inspector General of Police Joseph Boinnet to explain why Defence Permanent Secretary Saitoti Torome has not been arrested despite having been handed a jail term for contempt of court.
Justice Joseph Sergon said Boinnet needed to explain why Torome was still a free man even after the court gave him for six months behind bars for failing to follow court orders.
The same court last month sentenced Torome after he allegedly failed to obey court orders that directed him to pay Sh17.2M to a family that gave out their estate to the state in 2006.
“The respondents have failed to appear in court and mitigate as to why he has failed to honour court orders having cited for civil jail for contempt earlier,” the judge said.
In 2009, Hellen Makone and Eunice Makori moved to court to sue Saitoti through the Inspector General after they failed to give compensation for surrendering the late Johnson Onduko Makori's parcel of land in Mombasa city to the government.
