Opposition leader Raila Odinga received a major boost on Sunday evening following the decision of the Supreme Court to uphold additional affidavits that are vital in his case.
Odinga, who lost to President Uhuru Kenyatta, has since filed a petition seeking nullification of results as announced by the electoral body IEBC.
Initially, counsels representing Kenyatta had objected the additional affidavits claiming that they were file out of time and could prejudice their defense due to limited time of the case.
And in their unanimous ruling, the judges said that the documents were authentic and expunging them for court records would jeopardize the petitioned hence changing the dynamic of the case.
The latest ruling therefore means the respondents would have no choice other than to reply to the affidavits regardless of the time limitations.
On Monday trial judges would hear argument by petitioners led by senior counsel James Orengo who is appearing for Odinga for the second time in less than five years.
Should the case go in favour of petitioners, this would subject the country to another presidential election in two months time.
