Homa Bay Governor Cyprian Awiti got a major boost on Thursday morning after the Kisumu Court of Appeal threw out an application seeking to compel him to pay Sh20 Million as security before his appeal hearing.
This came after Awiti's rival in last year's gubernatorial poll Oyugi Magwanga, through his lawyer Charles Kanjama, filed an application seeking for payment of security costs.
In his suit, Kanjama argued that Governor Awiti had failed to pay the Sh2 Million petition costs as had been ordered by Homa Bay High Court when his win was nullified.
“While the total costs was Sh4 million, we have, however, applied Sh20 million to be deposited by the appellant to the court before hearing of the main appeal,” said Mr Kanjama as quoted by Business Daily.
In the case, Governor Awiti is represented by advocates James Orengo, Tom Ojienda, Anthony Oluoch and Otiende Amollo.
In April, the Homa Bay High Court nullified Awiti's win on grounds that the poll was not done in accordance to the stipulated laws.
The County boss, however, filed an appeal at the Kisumu appellate court arguing that the High Court ruling was not fair.
