Mombasa governor Hassan Ali Joho. [Photo/Capital FM]Mombasa governor Hassan Ali Joho is a happy man after the courts ruled in his favor in case that sought for scrutiny into the authenticity of his academic papers.
According to Judge Erick Ogola, the Director of Public Prosecution Mr Keriako Tobiko, Inspector General of Police Mr Joseph Boinnet and Directorate of Criminal Investigation violated Joho's constitutional right in pursuing the matter.
Ogola said the DCI wrongly used State machinery to abuse, breach, and violate Joho's rights, he also blamed the security agent of being slow to investigate the certificates.
The judge condemns the move by the security agents of freezing Joho's accounts and withdrawing his security team.
Ogola also questioned the timing of the investigation that has now happened twice, before the 2013 polls and the 2017 race.
Ogola therefore, ruled in favor of Joho asking the State to stop scrutinising the governor's papers. However, Joho is still facing a petition on his gubernatorial victory contested by former Mombasa senator Hassan Omar.Joho was not present during the Thursday verdict but his supporters who were at the court were in a jubilant mood after the ruling.
