The court has dismissed an application by the electoral agency IEBC CEO Ezra Chiloba seeking to overturn a suspension that was handed to him.
Mr Chiloba moved to the Employment and Labour Relations court on Wednesday morning wanting to block a compulsory leave handed to him by IEBC boss Wafula Chebukati.
" Public service is not ordinary employment it has the interest of the public," said Judge Stephen Radio.
In his petition, Mr Chiloba argued that the suspension letter handed to him was a breach of the law.
Mr Chiloba is also seeking to have the procurement misconduct raised against him disclosed.
He listed Commissioners Abdi Guliye and Boya Molu as respondents to the suit.
