High court Judge Aggrey Muchelule ruled that the petition filed by former Kathiani MP Wavinya Ndeti was not concrete to warrant nullification of the election.

The Judge noted that the petitioner failed to produce sufficient evidence to substantiate her allegations against governor Mutua's re-election.

 Ndeti filed the petition last year arguing that the Machakos gubernatorial contest was marred by illegalities and irregularities.

In the petition, the former Kathiani lawmaker accused governor Mutua of using county resources to fund his campaigns.

Ndeti also alleged that the governor intimidated her agents in some polling stations on the voting day.

She wanted Mutua's re-election nullified and IEBC directed to conduct a fresh poll.
