The High Court has declared the deportation of lawyer Miguna Miguna to Canada illegal null and void.
Justice Luka Kimaru ordered that Miguna's Kenyan passport be surrendered to court in seven days.
According to the judge, Miguna's deportation lacked legal merit.
Last week, the vocal lawyer was controversially deported to Canada after being held for five days.
A deportation order signed by Interior Cabinet Secretary Fred Matiangí indicated that Miguna was in the country illegally and his presence in Kenya was contrary to National interest.
The ministry further claimed that the self-proclaimed National Resistance Movement (NRM) general had renounced his Kenyan citizenship.
