The Kisii law courts on Tuesday morning upheld the election of Hon Oroo Oyioka as the dully elected MP of Bonchari.
Justice Antony Ndungu ruled that the petitoner failed to provide evidence that IEBC failed to conduct a free and fair exercise.
He also slapped the petitioner John Opore, who is also the former MP with a Sh 2.5 million fine.
Justice Ndungu also dismissed claims that the petitioner's agents and supporters were intimidated.
The judge added that the will of the people of Bonchari will not be nullified as the petitioner had requested the court.
Mr Opore had filed the petition on grounds that the election of of Oyioka was not free and fair.
Opore told the court that IEBC favovered his opponent.
He had asked the court to nullify the victory of Oyioka and order IEBC to conduct fresh elections.
