Kisii Governor James Ongwae has made it through an election petition challenging his re-election.

Justice Hellen Omondi upheld Governor Ongwae's election stating that the petition claims raised by the petitioners in seeking the nullification of the August 8 polls was insufficient.

Justice Omondi said, that anomalies raised in 184 polling stations can't be merited as the authenticity of the same can't be sustained since they didn't acquire or consult from the register. 

"Using numbers from all the elections is unmerited as the court lacks jurisdiction of analysing forms outside the gubernatorial elections. There was no primary documents of declaration either. Petitioner couldn't confirm any manipulation," said the judge. 

The judge then dismissed the case ordering the petitioner Makori Osando to pay Sh 5 million. 

Last year, the same court dismissed one of the two petitions challenging the election of Governor Ongwae. 

Judge Omondi dismisses the petition on grounds that it was defective. 

The petition had been filed by Lumumba Nyaberi who emerged third in the race.
