High Court sitting in Eldoret on Thursday nullified elections of outspoken Nandi Hills legislator Alfred Keter on massive ‘illegalities and irregularities’.
Petitioner Bernard Kibor had accused IEBC of colluding with Keter to rig him out in the closely contested polls.
Justice George Kimondo noted massive irregularities and illegalities in the evidence presented, adding that the respondent failed to give concrete counter evidence.
“Having scrutinized both evidence, I have noted illegalities committed by the second respondent during the said exercise.
“Further, the first respondent committed various electoral illegalities including breaching electoral code of conduct. I hereby order fresh elections to be conducted by the second respondent,” he ruled.
Keter becomes the second Jubilee rebel to lose seat in a span of three days after the same Judge sent Marakwet East MP Kangongo Bowen home.
The outspoken MP has been facing tribulations for days ever since his eviction as Labour Committee Chairman in parliament following instruction by President Uhuru Kenyatta.
During the August polls, Keter beat Kibor, a close ally of DP William Ruto, having scored 28, 923 votes to Kibor’s 13,872 votes.
Speaking outside the court, Keter said: "I expected this long ago. I am fighting a tough war but God loves all of us. We shall tell our people the next course of action."
