[Photo|Twitter]Law Society of Kenya (LSK) official has filed a petition against Supreme Court judge, Justice Njoki Ndung'u, seeking her removal from office.Lawyer Apollo Mboya filed the petition before the Judicial Service Commission (JSC), over alleged gross misconduct, and breach of her oath of office.Citing the dissenting rule that she gave, alongside fellow judges during the August presidential election petition, Mboya said it was not humanly possible for Njoki to examine all the disputed forms from August 28 to September 1, the date of the verdict.During her delivery of the verdict, Njoki said in paragraph 662 that fellow judges, who ruled in favour of the petition, failed to personally examine the original forms deposited at the registry, and that she examined each of the forms that had been disputed, in the interest of justice."Initiate the necessary procedures for the removal of the lady justice for misbehaviour incompatible with the status of a judge of a Supreme Court. In her summary she did not allude to the fact that she examined and verified each forms before arriving at the dissent," Mboya said, told JSC, in an affidavit.According to the lawyer, Njoki dishonestly ignored the forms tendered by IEBC for scrutiny and based her judgement on forms and materials that were not tendered for scrutiny.Mboya claims the lady justice, in her dissent, exhibited total lack of courtesy and civility towards her fellow judges, and bad judicial temperament in her general attitude towards the law and other judges as contained in her dissent judgment.The petition comes days after two petitions were filed against fellow judges.First petition was filed by Nyeri Town MP Ngunjiri Wambugu questioning the eligibility of Chief Justice David Maraga. It was however withdrawn.Another was filed against Deputy Chief Justice Philomena Mwilu and Justice Isaac Lenaola by Derrick Ngumu on claims they were in communication with the petitioner, NASA, during period of petition.
