Justice David Kemei dismissed the case challenging Munyaka's win for lack of sufficient evidence.

Kimei said the petitioner Urbanus Mutisya did not provide the court with satisfactory evidence to warrant nullification of the MP's election.

Mutisya who vied for the same seat on a Wiper party ticket was ordered to pay Sh4 million to be shared equally by the respondents.

The judge said the elections were free and fair.

"There was no iota of evidence that there were irregularities or voter bribery before and during the election," Kimei said.

Mutisya's lawyers had earlier asked the court for a recount of the total votes cast, a request that was rejected by the court.

Mutisya, however, said  he will appeal the ruling after consulting with his lawyers. 

This petition is the last one in Machakos County after the court on January 29, dismissed Wavinya Ndeti's petition against the incumbent Governor Alfred Mutua.

Munyaka is serving his third term in office as the Machakos town MP.
