Mandera Governor Ali Roba was on Wednesday handed a reprieve after the High court upheld his election.

In his ruling Justice Fred Ochieng dismissed the case, citing lack of evidence. 

Ochieng also said that the outcome of the election reflects the will of the people of Mandera, adding that the claimed discrepancies have no impact on the outcome of the election.

"Even if there were irregularities in Mandera County, they did not have any significant impact on the outcome," he said. 

He further ordered petitioner Hassan Noor Hassan to pay costs not exceeding Sh5 million to the Independent Electoral and Boundaries Commission (IEBC) and Mr. Roba and following the dismissal of the case. 

He also said that the claims that the IEBC altered the polling stations during the last general elections were baseless and could not lead to the nullification of the poll. 

The court has thrown out petitions challenging the wins of  Mr. Roba, Senator Mohamed Maalim Mohamud and MPs Bashir Abdullahi (Mandera East) and Mohamed Maalim (Mandera North). Mandera Governor Ali Roba at a past function.
