A case filed by ODM nominated MCA Damaris Mouni challenging her removal from office has been dismissed by High Court Judge James Makau.
In her petition, the Nyamira Assembly MCA claimed that she had been nominated and sworn in fairly, a move that was conspicuously opposed by her party.
"Having scrutinized the submissions by both parties, I hereby declare that the petitioner was irregularly nominated to assembly since no documents supports her argument.
"I hereby order the County Assembly Clerk to immediately swear in the first rspondent who was regularly nominated by the party," read part of the judgment.
The Judgment gives a reprieve to Daughters of Raila Odinga mobilizer Irene Nyakerario, who will now be sworn in as MCA to represent the Orange party's interest.
Last year, the party disowned Mouni's nomination claiming that she has been sneaked in by high ranking IEBC official.
When interviewed, Nyakerario said: "The truth has come out and the will of God is irresistible. I thank my supporters as well."
