The High Court sitting in Nyamira has dismissed an application from the former Kitutu Masaba MP Timothy Bosire that sought to have his successor, Shadrack Mose's victory nullified.
Through his Personal Assistant, Justus Omiti, Bosire had termed the August elections as 'opaque, fraudulent and illegal'.
But when delivering judgment on Thursday, Justice James Makau noted that the elections were conducted in a free, fair and verifiable manner.
"Having scrutinized evidence produced by both sides, I am hereby convinced that IEBC conducted elections in a free, fair and verifiable manner," read the judgment.
He further said: "The defects in evidence are incurable and I therefore order the petitioner to pay Sh5 million."
A close ally of Raila Odinga, Bosire who also serves as ODM National Treasurer, failed to reclaim his seat in 2017 after losing by a margin close to 13, 000 votes.
In parliament, Bosire is remembered for having defied President Uhuru when he ordered MPs to stand in honour of soldiers serving in Somalia.
