A Briton and a Kenyan national who were charged with trafficking cocaine valued at Sh598 million were on Friday released on bond.
This came after the High Court dismissed an application by the prosecution challenging an earlier release of the two on bond.
The two were released on Monday but Director of Public Prosecution Keriako Tobiko moved in swiftly and opposed the ruling by Justice Luka KImaru claiming that the two will abscond court sessions if released on bond.
Kimaru dismissed the application by Tobiko saying it lacked merit and the accused Jack Alexander Marrian and Roy Mwanthi have the right to bail pending trial.
The court in its ruling said that the DPP failed to prove that the two will abscond if they are released on bond.
Marrian and Mwanthi were released on Sh70 million and Sh60 million bond respectively.
