[Photo|Busia County Government]A Busia Court will give a ruling on January 10 whether to terminate a petition case challenging the election of Amukura Central Member of the County Assembly, Moses Ouma.Ouma's lawyer Joseph Makokha filed an application seeking the court to terminate the petition case filed by former aspirant who lost, Paul Okello. The third respondent claimed the petitioner served an amended petition instead of the original petition, thus making it a nullity.Chief Magistrate William Chepseba was scheduled to give the ruling today (Friday) but deferred it to Wednesday next week on grounds that he received submissions from the advocates late."I received advocates submissions today morning. I need some time to read them before giving the ruling. They are not very long I need at least two days to go through," he said. The petitioner's lawyer David Ashioya said they are set for whatever decision the court will make. "We are very confident that we have very strong petition."Advocate Makokha on his part said it is a good case. "Even if the court dismisses our application we are ready for the full hearing of the case," he said.Ouma beat Okello by three votes during the August 8 general elections.
