Two Mombasa based businessmen have moved to court seeking compensation after they were wrongfully prosecuted and imprisoned for the murder of the son of slain drug baron Ibrahim Akasha.
Mr Stojanovic Milan and Mr Dennis Waweru are seeking Sh1 billion compensation after the two were acquitted ten years ago for the murder.
The two claim they suffered losses and want to be compensated for damages done to their businesses, property and reputation after they were locked up for more than 2 years.
The duo was acquitted by the court on February 2, 2007 for lack of evidence.
The two were accused of killing Kamaldin Akasha on the night of March 28, 2002 at a petrol station that belonged to his father.
The two who are suing the State, said they were subjected to fear and anxiety for a period of three years due to their prosecution.
The respondents in the case are Senior Counsel John Khaminwa, Hayat Akasha Ibrahim, Baktash Akasha, Nuru Akasha and a policeman Boniface Ngatia Iregi.
Mr Milan told Judge Joseph Sergon that during their incarceration, he fell ill and had to be admitted at the Kenyatta National Hospital where he incurred a Sh1 million bill, adding that he also lost businesses and real estate property while he was in custody.
The judge said he will give directions on the case on September 19.
