The Court of Appeal in Kisumu has adjourned application by Kisumu County Assembly to challenge reinstatement of speaker Ann Adul and two other officers.

The appellate court ruled the stay order has extended beyond May 25 and file written submissions and serve the parties within 10 days.  

The preliminary issue whether the appeal is admissible was heard by justices David Maraga, Daniel Musinga and Gatembu Kairo.

While giving the verdict, Maraga said the respondents will also file their written submissions within 10 days.

"That will take us to the end of the month so that appeal case will be heard on June 17. We are proposing the hearing of this appeal to June 17," said Maraga.  

During the court session respondent 6th and 7th, Nelco Sagwe and Eluid Owen Ojuok had not been served with an application for the hearing.  

Earlier the bone of contention was the reinstatement of Adul as the speaker, Nelco Sagwe and Peter Anditi as the clerk and assistant clerk respectively by the industrial court after they were removed by members of the county assembly.

Maraga said that prosecution counsel should serve the respondents Nelco Sagwe and the 8th respondent who will be Eluid Owen Ojuok.

He said to balance the parties competing interest, they grant the order of injunction and stay pending appeal sort in the two applications for a period of the 60 days within which the applicant should lodge their appeals and have them determined.  

Maraga said the cost of the application would be in the intended appeal.

Adul and the other two officers later moved to the High Court after being removed but their case was transferred to Industrial Court.  

The Industrial court found out that the fundamental rights and freedom of Speaker Ann Adul were infringed since she was not given a chance to be heard hence the reinstatement.
