The judicial review case against Maseno University failed to proceed at the High Court in Kisumu on Wednesday leaving the disappointed, suspended students seeking answers to the delayed hearing.

Earlier this month, the institution through a letter signed by the Deputy Vice Chancellor for Academics and Students Affairs; Prof Mary Kipsat suspended 26 students from the institution.

Among those suspended includes some student leaders such as the Students Organisation of Maseno University (SOMU) President Charles Juma, his deputy Francis Okwara, Secretary General Syomanne Felix, a section of the directors and other students.

Among the accusations levelled against them included causing students unrest and obstructing university staff from performing their duties, detaining, holding staff hostage and forcing staff from offices, inciting students and participating in unlawful demonstrations, inflicting fear on both students and staff by acts of hooliganism, using profane or abusive language against students and staff, violation of suctions among others.

The suspended students were required to record a statement with the Dean of Students’ office in May 26, 2015 and appear before the Students Disciplinary Committee from next week on Wednesday to Friday.

A section of the suspended students sued the university through their lawyer Tom Adiso and Judge Esther Maina certified the matter as urgent saying that the case will be heard next week on Wednesday.

Speaking to the students outside the Court on Wednesday, lawyer Adiso asked the students to remain calm as they wait for hearing next week.

“We will ensure that justice is served and you all definitely resume your studies without wasting any time meant for your studies. All we need to do now is to remain calm and allow justice to take its course,” said Adiso.

Kisumu County Students Union (KICOSU) through their officials who were also present condemned the suspension saying the decision is malicious and asked the students to remain calm and united as they await hearing next week.

KICOSU Secretary General Fred Makajos asked the students to be united and refrain from acts that might cause them more problems.

“This is the time for us to ensure that we are united to this course as we seek justice,” said Sec. Gen Makajos.

Lawyer Adiso said that he hopes to seek a Court order stopping the students from appearing before the university disciplinary committee as the matter is already before a court of law.
