The case filed by the National Super Alliance (Nasa) seeking cancellation of ballot paper printing tender awarded to Dubai-based firm, Al Ghurair, will be heard on Friday.

 The case failed to kick off at the high court after some parties asked for more time.

Judges Joel Ngugi, George Odunga and John Mativo will now hear the case this Friday with Al Ghurair terming the claims by NASA as mere allegations meant to derail the electoral process.

The three presiding judges directed the parties in the case filed by NASA to file their replying submissions by the close of the day Wednesday.

The judges have further enjoined Independent lobby group chairperson Steven Owoko as an interested party in the case.

Justice Ngugi issued the directions in a case where NASA is claiming that IEBC awarded ballot paper tender to Dubai based printing firm, Alghurair unlawfully.

NASA further alleges that Al ghurair group CEO had a meeting with President Uhuru Kenyatta who is also a presidential candidate in the August polls. 

The application by NASA also alleges that while making the decision to award the tender to Al ghurair, IEBC did not consult the stakeholders as required by law.

However, IEBC in their response said the relationship between the president and Al ghurair cannot to be subject of a judicial review application.

IEBC at the same time accused the NASA coalition of insincerity saying that the electoral body met representatives of political parties including those of the petitioner where they were informed of the plan to directly procure Al Ghurair to print ballot papers and the reason for the decision.

Al Ghurair has dismissed the applicant saying they have no basis for the claims saying the sole intention of the petitioner remains to derail the highly sensitive strictly time based final stages of the Kenya electoral process and to ensure that its contract with IEBC is unjustifiably terminated.
