IEBC chairman Wafula Chebukati has accused suspended CEO Ezra Chiloba of lying to the court about his suspension from the polls agency.
According to Chebukati, Chiloba alleges that there was no quorum in the decision to suspend him.
Chebukati in papers filed in court states that the meeting to suspended Chiloba was properly constituted with five commissioners.
“That even for a moment the Honourable court were to buy the outright lie that the decision was reached at by only the 3 commissioners after the alleged protests by the remaining two commissioners, the courts have held that quorum is not taken away through withdrawal of members,” says Chebukati.
Chebukati further states that Chiloba’s employment contract prohibits him from instituting legal proceedings against IEBC.
