The Supreme Court is on Monday set to give directions in a case filed by IEBC seeking to clarify what to do in case errors are noted in the verification of presidential results.
Parties in the suit were on Friday notified to appear before the court for directions.
Through lawyer Kamau Karori, IEBC chairman Wafula Chebukati had sought the court's help to clarify what he should do with the errors when verifying the forms.
The commission said there was confusion in the judgment the court issued on September 20 since the judges maintained that the chairman must first verify the results before declaring the winner.
IEBC say it is necessary the court clarifies whether Chebukati and the entire commission can correct any errors in Forms 34B in case the results do not tally with those captured in Forms 34A.
“Clearly, there was an oversight in the judgment to the extent that the court did not complete its directions on how the 2nd Respondent (the chairman) should handle or treat any discrepancy in the tallies in Forms 34B when compared with the tally of the results in Forms 34A,” Chebukati said in an affidavit.
