As the constitutional timeline for Presidential petition elapses, President Uhuru Kenyatta faces a risk of having his victory nullified yet again, says lawyer Okong'o Mogeni.

Although the opposition team has dismissed planed to challenge the October victory, Okong'o says the case has merit that the August petition.

"This is one of the case that will easily sail in Supreme Court. Any Kenyan who is interested will easily send Uhuru home," he says.

In a widely boycotted election, Uhuru could be facing yet another tough battle this time from among members of civil society.

The Nyamira senator notes that IEBC chairman Wafula Chebukati's actions before the repeat poll are enough to have the outcome nullified.

"You only need to have someone swear an affidavit and attach Chebukati's memo to Ezra Chiloba and demand responses.

"Then you again play an audio of Chebukati where he admitted that he was unable to deliver a credible poll," he further says.

Despite the repeat poll being held within 60 days provided by the constitution, opposition leader Raila Odinga has since dismissed it as a sham.

Prior to the elections, the embattled chairman called for dialogue between Uhuru and Odinga threatening that he would not conduct an election if the two failed to meet.
