A man charged with defiling a 15 year-old girl will have to wait for age assessment before Thika Law Courts issue further orders on Monday May 18. Dominic Mwangi was accused of allegedly detaining and raping a 15 year-old girl, a Standard Seven pupil of Muiri Primary School. The court heard that the accused had sex with the minor for six days in a well fenced compound before she managed to escape. She was proceeding to her uncle’s place on May 3 when she was abducted by a group of muscled men who drove her to the accused person’s home. The girl was given to accused as a wife by her parents who had plotted her abduction. The girl’s father told accused person of her daughter’s visit to the uncle’s place that in turn ensured a well-armed group of men who managed kidnapping her. The prosecution was able to provide evidence to prove that the girl from Igembe in Machakos County was indeed a child, a pupil and was forcefully married to the accused. It was also established that the minor’s parents accepted a bride price of 20 goats and 20 cows which were paid in advance after the two parties had reached an agreement. The prosecution further successfully proved to the court that the accused was guilty of five counts against him. The girl was later taken to Thika District Hospital for examination after she had complained of being raped where it was established that she was defiled on six different occasions. The hospital report indicated that the girl had virginal discharge, Female Genital Mutilation (FGM) scar and HIV negative and aged 15. It was also found that the complainant was pregnant for the accused man. The court prosecutor Chief Inspector Ali told the court that the accused still believes the complainant to be his wife as he had already paid bride price. In his mitigation the accused disclosed that he is the only one his family is depending on since his mother is sight impaired while the brother could not walk. The accused was arrested at the uncle to the minor’s place on May 8 this year where he had followed her after escaping. Senior Principal Magistrate, Stephen Mbugi ordered the accused to go for age assessment at Thika health facility before ruling is made.
