Chiloba, who had been sent on a three-month compulsory leave by IEBC Chairman Wafula Chebukati moved to court in April to challenge the decision.

In his case, Chiloba argued that he was not given an opportunity to defend the action and listed Commissioners Abdi Guliye and Boya Molu as respondents to the suit.

He requested the court to issue temporary orders banning the suspension until the matters is heard and a ruling delivered.

Earlier this year, Chebukati suspended Chiloba following procurement queries at the electoral body.

The IEBC Chairman noted that the CEO's suspension was meant to create room for investigations to be conducted on the matter.
