On August 28, 2013, a Kisii ward representative, Samuel Apoko hit news headlines after he publicly said that those close to President Uhuru Kenyatta should advise him not to smoke bhang.
This made the ward representative face a court case on grounds that he disrespected the office of the president.
This was on April 29, 2013, where the prosecution told Kisii Principal Magistrate Kibet Sambu that Mr Apoko words were calculated and intended to bring into contempt the lawful authority of a public officer.
"Any person who, without lawful excuse, the burden of proof whereof shall lie upon him, utters, prints, publishes any words, or does any act or thing, calculated to bring into contempt, or to excite defiance of or disobedience to, the lawful authority of a public officer or any class of public officers is guilty of an offence and is liable for a term not exceeding three years," states Chapter 13 Section 132 of the Penal Code which the prosecution intends to use to press their case.
He was charged with undermining the authority of a public officer contrary to Section 132 of the Penal Code.
Mr Apoko denied the charges before principal magistrate Kibet Sambu and was released on a cash bail of Sh20,000.
The MCA is a laboratory technologist turned politician.
It is yet not clear whether a move by President Kenyatta to forgive the Seventh Day Adventist church elder would affect the case.
Mr Apoko is currently the chairman of ward representatives from Nyaribari Chache constituency.
He is a father of five and he graduated from Mombasa Polytechnic in 1996.
He unsuccessfully vied for the councillor's position in 2007.
