Five Nairobi county employees who were caught with Sh7 million stashed in their office have moved to court seeking to bar DPP Keriako Tobiko from prosecuting them.The five, who include Luke Gatimu, Maurice Ochieng, Nixon Awuor, Shaban Asman and Bedan Wambui, through their lawyer John Khaminwa, say they are raising serious constitutional issues and if their trials are not halted, they will suffer serious prejudice."Our application seeks to enforce our fundamental rights and stay any further investigations by the against us with regards to the events of August 23, 2017," Awuor says in an affidavit.They were found in possession of Sh7,803,876 at City Hall's cash office, monies which ought to have been deposited at the bank by close of business on August 22.The five were arrested on August 29 alongside other people after Nairobi Governor Mike Sonko filed a complaint with the police.The accused were later arraigned before resident magistrate Sinkian Tobiko where they were accused of being in possession of the said money.According to the prosecution, the officers abused their office when they kept the money in the office.
