Chief Justice David Maraga (photo/nation.co.ke)Chief Justice David Maraga has on Tuesday given urgent orders that may affect the Thursday presidential repeat poll.
In his ruling, Maraga directed that all presidential candidates, including Jubilee’s Uhuru Kenyatta to respond to a case that has challenged the Thursday poll.Maraga responded to a petition filed before the Supreme Court that had sought to stop the IEBC and its Chairman from conducting the October 26 election. The case filed by three Kenyan voters, had earlier suffered an obstacle after Interior CS Fred Matiang’i declared Wednesday a public holiday to enable voters to travel prior to the repeat poll. However, Maraga has directed that the case would go on despite the fact that Wednesday would be a public holiday. He also directed the petitioners to serve all candidates by Tuesday afternoon.“The respondents and all presidential candidates to file and serve their responses as well as written submissions by 8.30 am tomorrow morning. Matter to be heard tomorrow notwithstanding it may be a public holiday,” directed Maraga.
