Chief Justice David Maraga has come under criticism over alleged road prouncements on critical issues touching key institutions.
Maraga, who is yet to celebrate his first anniversary in office, recently said courts would not interfere with the date of August elections despite the controversy surrounding it.
NASA coalition had move to court to challenge awarding of ballot printing tender to a Dubai based company on grounds that it had strong links with Jubilee luminaries.
“CJ must learn to make pronouncements that are accompanied by notes. This habit of standing on roadsides to issue statements of sensitive issues should stop,” said James Orengo.
“I thought he understands the law that he is the head of judiciary. I am appalled that he is showing his stand even before a matter is brought before him,” added Moses Wetangula.
The case on spot has been since subjected to a three bench judge that would hear submissions from petitioners and defendants on Tuesday.
Despite the case, IEBC has confirmed that printing on ballot papers without controversy is ongoing.
