A resident of Tudor in Mombasa has filed a case against the Coast Water Services Board over tender allocation.

The man, Samuel Ensom, has asked the High court to freeze the courts of the board.

The move is meant to bar the management from misappropriating the funds during the campaign period.

Ensom pleaded with the court to issue the directive for the freezing of the accounts pending investigations into the matter.

The complainant wants the board barred from awarding any tender until a new chief executive officer takes over office.

He has requested the court to bar the CEO, Jacob Kimutai, from conducting his duties on grounds that his recruitment was not carried out as per the required procedures.

“The recruitment of the new CEO was secretive and against the law, which process has to be checked and nullified," he said, as quoted by Standard.

He further said that Mr Kimutai is holding office illegally hence should not be recognized nor allowed to conduct any business on behalf of the board.

“It’s unlawful for Kimutai to continue being in office without the approval and knowledge of the public through public participation,” said Ensom.

The Labour and Relations Court had issued Kimutai with a contempt notice on May 14 for assuming office before approval.

“Kimutai has deliberately and with impunity failed to obey the order, hence it is in the interest of justice that this application is heard urgently,” read part of the notice.
