The Nakuru children’s court directed Utalii College student Mary Gathoni and Stanslous Katiku, who are involved in child maintenance dispute, to avail themselves today for DNA samples to be extracted.

Katiku, who was sued by the college girl for allegedly abandoning her two months after the birth of the baby, sought orders for a DNA test to prove fatherhood of the child.

He had also urged court to set aside orders issued on May compelling him to pay Sh16,000 per month for the maintenance of the minor born on February  26 this year.

Gathoni, a resident of Lanet in Nakuru, moved to court in April this year seeking court orders to have Katiku pay Sh16, 000 every month for the upkeep.

She said the two cohabited for some time in 2013 before breaking up and Katiku refused to support her after birth of the minor and has been reluctant to support the child ever since.

There was disagreement in court after lawyers representing the parties differed on the DNA test venue.

Gathoni, through her lawyer Steve Biko, wanted it done at Kenyatta National hospital while Katiku’s lawyer wanted it done at the government chemist.

However, the court ruled that the exercise be carried out at the government chemist and ordered the student to contribute for the test cost.

Magistrate Nthuku also ordered that should the results show Katiku is not the biological father, the woman should refund DNA costs and vice versa.

The case will be mentioned on November 25.
