Congolese national facing charges of being in the county illegal told a Mombasa Court that he had been sexually assaulted by inmates.
The man told Resident Magistrate Judy Kassam that the inmates at Shimo la Tewa Prison sexually assaulted him following his arrest in December.
He further told the court that he was also tortured by other prisoners where he is being held saying he believes he was in grave danger and should not be taken back to the prison.
The accused filed an application before Magistrate Kassam to release him on bond or order his deportation or transfer to another prison.
He described his detention in the prison as weeks of rape, denial of food and anguish in the cells adding that authorities at the prison have ignored his pleas for remedial action.
The accused displayed torn clothes before the magistrate alleging that they were ripped apart by his attackers.
He was arrested in December, last year and was facing charges of allegedly being in the country without legal documents.
Magistrate Kassam could not rule on the application because she was holding brief for trial magistrate, Henry Nyakweba.
