Lawyer James Orengo claims IEBC Vice Chair Consolata Maina has been prepared to announce presidential results on Thursday's planned election.
A memo signed by IEBC chairman Wafula Chebukati indicated that the commission had assigned Ms Maina roles of the Deputy National Returning officer.
But Orengo says the creating of the non existence position is a plot by majority commissioners leaning towards Jubilee to validate the elections.
"The position of Deputy National Returning Officers does not exist.They know Chebukati is not ready to be part of the sham elections.
"By coming with such a position, they now want to impose Uhuru through the Vice chairperson who does not have such powers," said Orengo.
Last week, Chebukati insisted that he cannot guarantee free and fair elections in the current political environment adding that his efforts within the commission were being frustrated
His remarks came moments after commissioner Roselyne Akombe bolted out of the team citing fear for her security in the poll that has seen opposition leader Raila Odinga withdraw..
