Controversial lawyer Prof Makau Mutua will now face the Judicial Service Commission interview panel on September 13 for the post of Chief Justice.

His inclusion in the list of interviewees for the post of CJ followed a Monday High Cout ruling that said all applicants whose names were excluded from the list be interviewed.

Prof Mutua's name was among applicants' names expunged from the JSC list looking forward to replace former CJ Dr Willy Mutunga who resigned in June.

High Court Judge George Odunga in the Monday ruling said all applicants had the right to be given a fair hearing.

There were claims that Prof Mutua's name had been deleted from the list because of his constant criticism of the Jubilee administration.

He has since 2013 been hitting out at the government over corruption and tribalism.

For the post of Chief Justice, applicants Prof Mutua, Andrew Udoto, Aaron Ringera, David Wambura, Jackton Ojwang' and Lucy Wanja's names were rejected.

The case against the JSC was filed by Arnold Magina, Trusted Society of Human Rights Alliance and former Constitution of Kenya Review Commission chairman Prof Yash Pal Ghai.

Prof Mutua's names deletion had been interpreted as political.

He is seen as a supreme contender for the post because of his rich CV.
