Former Laikipia North MP Mathew Lempurkel was on Monday expected to presented in court.
The former controversial lawmaker had spent two days in police custody.
He was arrested on Sunday evening and locked up at the Nairobi Central police station.
He was unable to appear before the Kibera law courts on Monday due to post-election protests in the area.
Police have declined to say why the former MP who is already facing charges of incitement was arrested.
