Following the decision by the Independent Electoral and Boundaries Commission (IEBC) to vacate office, leaders from the largest coalitions are in disagreement on the nomination procedure of the team to replace the commissioners.

This has led to a major rift already taking shape between the warring political opponents on how best to constitute a panel that will lead the process of appointing the new commissioners.

Some of the Jubilee members are also saying that the send off package requested by the IEBC commissioners and the secretariat is not tenable with the current budget since the over 180 million allocated to them till their term expires in November 2017 is high and a burden to the taxpayers.

Secondly, Cord MPs want a new voters register to be formulated and the current one be rejected. The opposition further argues that there are 1.2 million Kenyans with Identity Cards but don't have a voter's card.

The Justice and Legal Affairs Committee Committee of the National Assembly has, on the other hand, tabled a bill in parliament to amend the IEBC Act, which stipulated how to form the selection committee to interview the commissioners, the bill has come under attack from MPs from both sides of the coalition.

The current IEBC Act, enacted in the last Parliament during the Grand Coalition Government, stipulated that both the President and the Prime Minister are to appoint two members to the panel, with three other professional bodies each sending one nominee to the panel.

But with the position of PM defunct, the Samuel Chepkonga led committee has proposed in IEBC (Amendment) Bill  the two political players, Majority and Minority parties, nominate two members to the committee each with three others appointed through a competitive process conducted by the Public Service Commission (PSC). 

But Wednesday, the House leadership in both coalitions appeared to oppose the proposal in the bill by committee saying that the process should also invite other stakeholders like the clerics and civil society groups.

However, it has been agree upon that no vacuum will be left in the IEBC and the current commissioners should leave office once a new replacement is formed. 

Cord leader has welcomed the decision by the electoral team to leave office. Suba MP and ODM chairman also welcomed the decision but questioned why they took long to arrive the decision leading to lose of five lives in Siaya and Kisumu counties.
