Homa Bay Town MP Peter Kaluma has said the arrest of five Cord legislators over claims of hate speech are unfair as there is no case where they have been quoted propagating tribal animosity.

To him, the charges against the five are flimsy and do not warrant any arrest.

This comes just two days after Cord MP's Junet Mohamed, Timothy Bosire, Florence Mutua, Asha Jumwa and Machakos Senator Johnston Muthama were arrested alongside their Jubilee counterparts for allegedly propagating hate speech.

According to Mr Kaluma, the statement by Kilifi Woman Representative Asha Jumwa that no dialogue will be done with Moses Kuria should not be treated as hate speech.

Further, he said the fact that Machakos Senator Johnston Muthama threatened to lead a demonstration to the office of the Inspector General of Police should Moses Kuria not be arrested over his assassination remarks is not hate speech to warrant the wiper politician an arrest.

Speaking in an interview at  KTN on Thursday, the MP said that the statement from Mr Kuria should not be taken lightly as a claim of assassination carries a lot of weight which needs to be speedily investigated.

On the issue of NCIC, the legislator faulted the Francis Ole Kaparo-led body for being a lame duck.

He says the commission has reduced itself to a hate-speech fighting body when it is supposed to be fostering cohesion in the country.

He further claimed that tribalism in Kenya comes out of the unwillingness by the leadership to face it head on.
