Mr Wandayi was suspended from Parliament after Mr Muturi ruled that he broke House Standing Order 111 which says an MP who disobeys a directive to leave the House as ordered by the Speaker shall be suspended.

The suspension followed the famous whistle blowing incident in which Cord MPs disrupted the State of the Nation Address by President Uhuru Kenyatta early April.

Wandayi following the suspension however, mover to court to challenge his ejection from Parliament.

High Court Judge George Odunga in his ruling said the MP had every right to be in Parliament since his absence denied residents of Ugunja constituency House representation.

On his return to Parliament last week however, Muturi maintained that Wandayi shall serve his suspension fully and was therefore denied access to the House.

Muturi argued that the Judiciary, Parliament and the Executive were independent arms of government.

He said courts, therefore, had no authority interfering with Parliamentary business.

"The Speaker has no power over the courts," Nyando MP Fred Outa said in Kisumu on Friday.

"He must respect the court and that is why we have resolved to disrupt National Assembly proceedings on Wednesday if Hon Wandayi would not have been allowed to the House by then."
