The county government of Nyamira risks paying over Sh20 million to a local legal firm following alleged non-compliance to payment terms.
City lawyer Steve Mogaka moved to the Kisumu High Court seeking to compel the county government to pay his firm, Mogaka Advocates, after winning a case against former speaker Samuel King’oina.
Mr King’oina had sued the county assembly and the county government of Nyamira for wrongful dismissal from his job.
Speaking to the writer on Tuesday evening, Mr Mogaka accused the county government of ‘sabotage’ and expressed his optimism to win the case.
“I moved to court to seek justice. My legal team rendered services but our client (county government) has failed to honor our terms and conditions,” Mogaka said.
“I have done my best to coordinate with the finance department and the county government but nothing is forthcoming. The law is very clear and I had to make that difficulty decision,” he added.
Mr Mogaka said he arrived at the decision after his efforts to seek redress from the county boss John Nyagarama hit a snug.
“We were supposed to receive Sh10 million for legal services but the county has decided to sabotage our rights. The county governor has equally failed to intervene so the only option left was court and I have done that. They will have to pay double the amount following torture they have inflicted on us,” he said.
The office of the Governor has not made immediate reaction to the new development since the Governor is in China for an official trip and the first ruling of the case on its admissibility is set for Wednesday afternoon.
