The Kisumu Environment and Lands court is expected to deliver a ruling today indicating whether the county government can continue relocating the Kachok dumpsite or not.

The ruling comes after a section of Kajulu residents moved to court, protesting a decision by Justice Stephen Kibunjia issuing a green light for the transfer of Kachok dumpsite waste to an abandoned concrete quarry in Kajulu.

Three petitioners; George Ondere, Titus Achar and Rose Juma want the court to issue orders halting the exercise citing catastrophic health problems the muck may bring to the residents.

The county government has been listed as the first respondent while City Manager Doris Ombara and NAYA Holdings Limited which is the company contracted to extract and transport the waste have been listed as the second and third respondents respectively.

In the case, the petitioners claim that the NAYA Holdings Limited was given a contract worth sh99.3 million without proper procedures of public tendering being followed.

The petitioners through their lawyer Moses Omondi and Mitch Menezes further argued that NAYA holding is just a construction company and is not certified to carry waste.
