Stephen Irungu, a taxi driver in Nairobi's Eastleigh Estate was set free by Kangundo Law Courts for lack of adequate evidence on Tuesday.

According to Senior Principal Magistrate Desderious Orimba, the prosecution didn't provide the court with indisputable evidence.

In his ruling, Judge Orimba said the prosecution could not prove beyond reasonable doubt as required by the law that the accused was involved in the murder.

Irungu had been charged with handling stolen items contrary to the law.

This is after he was nabbed with some of the stolen items from the late don's house.

''The prosecution released a circumstantial evidence which didn't point to the guilt of the accused," Orimba said.

Another suspect in the case, Cyrus Mutunga Masaku, an alleged Veterinary officer, was discharged by the same court on November 14th, 2017 for lack of enough evidence linking him to the professor's murder.

This was after records from a communications service provider, Safaricom proved that Masaku was in Eldoret at the time when the crime was committed.

Professor Nzuve was murdered on December 12, 2015 at his rural home by armed robbers who broke into his house in Tala, Machakos County.

The robbers made away with items belonging to the professor and his wife's which included laptops, wrist watches, ATM cards, mobile phones, wedding ring, among other things.

The third suspect, Domnic Mutua's case is slated for mentioning in the same court on April 19, 2018.
