A Nairobi court has exonerated Gatundu South MP Moses Kuria over alleged incitement to violence remarks citing lack of evidence.
The legislator was charged in May 2014 for the remarks that were reportedly posted on his Facebook page.
The prosecution had told the court that the accused said that the terror attack which happened in Gikomba Market killing 15 was orchestrated by “Odhiambos” and not “Somalis”.
In her ruling, Magistrate Teresia Nyangena, said the evidence presented before her did not establish that the said Facebook account belonged to Kuria.
According to the magistrate, the prosecution also failed to satisfy the court by illustrating the manner in which the legislator updated his status.
The prosecution had told the court that Kuria posted in his Facebook account messages which were “calculated to cause ethnic contempt among three ethnic communities”.
