A Magistrates Court in Nairobi has adjourned a fraud case against lawyer Kethi Kilonzo.
Milimani Chief Magistrate Francis Andayi, adjourned the case on Tuesday to give the prosecution time to get instructions from the Independent Electoral and Boundaries Commission (IEBC) on whether to proceed with the case or nor.
Kethi is facing charges of allegedly uttering false documents and presenting them to a Returning Officer, forging and stealing an IEBC acknowledgment slip.
The lawyer is said to have committed the offense when she was clearing to contest in Makueni senatorial by-election in 2013 after the sudden death of the then senator Mutula Kilonzo.
Kethi denied the charges and is out on bond.
In December last year, the lawyer accused the office of the Director of Public Prosecutions (ODPP) of allegedly stalling the case.
The lawyer has also written to IEBC asking the electoral agency to withdraw the case on grounds that the prosecution has failed to bring witnesses to court.
The magistrate gave the prosecution one month to get instructions from the IEBC on whether it is ready to withdraw the matter or not.
The case will be mentioned on March 26.
Kethi came to the limelight when she represented NASA leader Raila Odinga in the 2013 presidential election petition.
The lawyer was later thrown into political waters when she was recommended by Wiper party too contest for the Makueni senatorial by-election after the death of the late Mutula Kilonzo.
Kethi later declined the offer and giving space to his brother Mutula Kilonzo Junior (the now Mkaueni sentor) to contest.
