The case against a male nurse attached to a private hospital in Nakuru who was charged with attempted rape has been adjourned.

Prosecutor Rop Sirorei urged the court to postpone the case to allow the witnesses to be availed in court to testify against the accused. 

Principal Magistrate Felix Kombo said the case will proceed to a hearing without any further mention as it was a sensitive matter.

The nurse, Macharia Ochomba, is accused of attempting to rape a patient on June 17 at Baraka nursing home in Nakuru town. Ochomba was accused of allegedly injected the patient with a sleeping drug before attempting to rape her.

She was, however, rescued by another nurse on duty at about 2am. The complainant claimed that after the injection, she felt drowsy and that is when the accused came back to the room and removed his jacket.

The accused allegedly fondled her bosom and tried to put her legs apart when she woke up and confronted him. The complainant said she was being attended to by a female nurse, but on Sunday, a male nurse came in at 1am and woke her up to check how she was doing.

She alleged that she was injected with some medicine after she claimed that she was in a lot of pain. The nursing home’s proprietor, Dr Isoe Ochoki, acknowledged the incident, saying an action will be taken against the nurse if found culpable.

Ochoki confirmed the accused nurse was on duty on the material night but he is yet to terminate his services because investigations are not complete. Ochomba, however, denied the charges and was released on Sh200,000 bond.

The case will be heard on October 22.

According to the code of conduct for Kenyan nurses, health workers are prohibited from sexually harassing any member of the public, patient or colleague.
