An Utalii College student has told a Nakuru court that she is ready for a DNA test to establish the paternity of her child as demanded by her former lover.

Mary Gathoni told resident magistrate Judicaster Nthuku that she was ready for the exercise to proof whether Stanislaus Kimatu, an employee with a telecommunication company in Mombasa, was the biological father of her 6-month-old child.

Gathoni, through her lawyer Steve Osur, insisted that Kimatu was the father of the child and that the test will be crucial to serve as evidence in the case.

“He is the biological father of the child and should carry responsibility of providing for her upkeep,” the lawyer told the court.

In the case, Gathoni moved to court on April 5 seeking court orders to have Kimatu pay Sh16,000 every month for the upkeep of the child. She also sought legal and actual custody of the minor claiming Kimatu has failed to take his obligations as a father.

"The accused refused to support me after birth of the minor and has been reluctant," Gathoni averred in a filed affidavit, which also indicated that the two cohabited sometime in 2013 before a break-up.

Gathoni, a student in Mombasa alleged that she has been chased away by her parents since they want Kimatu to take responsibility of his biological child.

On his part, Kimatu refuted the claims that they have been in an intimate relationship, arguing that she was only a friend.

"She came demanding for the upkeep money and threatened to file a court case," Kimatu said.

He said that Gathoni was misleading the court and trying to take advantage of the fact that he is employed to demand child upkeep.

Justice Nthuku granted request for DNA test but said she will give a DNA test order on September 16.

Kimatu had demanded for the test be carried out to establish the biological father.
