Police in Gatundu have been allowed to hold for five days a police officer suspected to have defiled a 15-year-old girl to allow them to complete investigations.

Resident Magistrate C M Makari gave the ruling on Tuesday after the investigating officer in the case, Corporal Ekiru Ekirimon, asked for more time.

Defense counsel had earlier opposed the prayer arguing that there was no holding charge and the suspect was a law-abiding citizen and his continued detention was unconstitutional and holding him without any charge being preferred against him was a breach of his constitutional right.

But prosecuting counsel Kerogo Matwa told the court that it was common practice for police officers to request for more time to request courts to give them more time to conclude investigations adding that there were conflicting authorities on the issue.
