The Employment and Labour Relations Court has barred Kenya Airways from carrying out its plan to replace the engineers it sacked last week.
Furthermore the airline has been ordered to suspend any plans they may have of firing the 131 employees but it did not order that they be reinstated..
This comes after the employees filed a case through their lawyers petitioning their dismissal.
“Pending inter-partes hearing and determination of this application, an order be and is hereby issued against the respondent directing the suspension of the purported dismissal of the applicants and maintenance of the status quo with no loss of seniority, privileges, salary, benefits and allowances,” the court order stated.
According to the penal notice issued by the courts registrar, the airline is at risk of being sued for contempt of court should it fail to obey the orders.
However, KQ through their chief executive claim that the issues raised by the employees had already been resolved early on in the year.
“Kenya Airways management consistently communicated, in good faith, the progress of addressing issues raised by the technical department. Key was remuneration, and this was addressed earlier in the year,” Kenya Airways chief executive Sebastian Mikosz said.
